Terms of use

MarkerPen is operated by Jigsaw Software Development Ltd, a company registered in England and Wales ("we", "us"). By creating an account you agree to these terms.

The service

MarkerPen generates draft feedback on student work using AI, against the instructions and criteria you provide. It is an assistant, not an examiner: you review and approve all feedback before use, and you remain responsible for any assessment decisions communicated to students. AI output can contain errors.

Your content

You retain all rights to what you upload and to the feedback you save. You grant us the limited licence needed to store and process it to provide the service. You confirm you are entitled to upload the content you submit, including student work, and that you will use the service in line with your institution's policies. We keep the text we read from the files you upload, and your feedback, with your account. Files for a brief or a class list are deleted once they have been read; photos and files of student work are kept until you approve that work's feedback, then deleted, except student work containing a diagram, drawing or design, which we can keep with its brief until you delete the brief or your account. Keep your own copies of anything you need for longer.

Acceptable use

No unlawful content, no attempts to breach security or extract other users' data, no reselling of the service, and no use that would breach a student's reasonable expectations of privacy.

Assessments and payment

Every account starts with 30 free assessments, which never expire and are not renewed. Further assessments are sold in packs (at the prices shown on our pricing page, including any applicable taxes) by Onelink, a Stripe company, as seller of record. Their terms of sale govern the purchase. Assessments you buy do not expire. If MarkerPen were ever to close, we would give you at least 90 days' notice by email, your assessments would keep working until the closing date, and we would refund any assessments you had bought but not used. Prices are shown in your local currency at checkout.

Service and liability

We aim for high availability but the service is provided "as is" without warranties. To the extent permitted by law, our total liability is limited to the amount you paid us in the twelve months before a claim. Nothing in these terms limits liability that cannot be limited by law.

Ending the agreement

You can delete your account at any time. We may suspend or terminate accounts that breach these terms, with notice where practicable.

Governing law

These terms are governed by the law of England and Wales.
